Risk Acknowledgement & Customer Responsibilities

1.1 Acknowledgement of Risk

By using TheVanApp, Customers acknowledge and accept that:

  • Transportation of goods involves risks of loss, theft, damage, or delay.
  • Neither TheVanApp nor its Partners can guarantee absolute safety during pickup, transit, or delivery.
  • Collection and delivery times are estimates and may be affected by traffic, accidents, weather, or operational issues.

1.2 Packaging Responsibilities

Customers are solely responsible for ensuring that all items are:

  • Properly packaged and secured to withstand handling and transport.
  • Packed suitably for the item’s nature, fragility, and value.
  • Clearly labelled with accurate pickup and delivery details.

TheVanApp and its Partners may refuse or cancel a booking if items are inadequately packaged or pose safety risks.

1.3 Declaration of Items

Customers must provide truthful and accurate descriptions of all items to be transported. Customers warrant that items do not contain:

  • Illegal substances or contraband.
  • Prohibited or restricted goods as listed in Section 3.2 (Prohibited Items Disclaimer).
  • Items requiring special licenses or regulatory approval unless such authorization is provided.

Any misrepresentation, concealment, or false declaration is at the Customer’s risk and may result in cancellation, reporting to authorities, or legal action.

1.4 Compliance with Laws

Customers agree their use of TheVanApp complies with all applicable local, national, and international laws. Services must not be requested for unlawful purposes, including transporting stolen goods or contraband.

1.5 Liability for Costs & Losses

Customers are liable for any costs, damages, fines, or losses incurred by TheVanApp or its Partners resulting from:

  • Transporting prohibited, misdeclared, or improperly packaged items.
  • Violations of applicable laws or regulations.
  • Misuse of the App or services.

Customers agree to indemnify and hold harmless TheVanApp against all such claims, costs, or liabilities.

1.6 Responsibility for Receipt of Items

Customers must ensure a responsible recipient is available at the delivery location. If no recipient is available, items may be returned or rescheduled at the Customer’s expense. TheVanApp is not responsible for losses or delays arising from failed deliveries due to recipient unavailability.
